These Terms apply to all Services and Goods we supply, together with your accepted Quote. If there is an inconsistency, your accepted Quote prevails.
1. Services and Service Area
1.1 We provide installation, repair, maintenance and sales services for garage doors, automated gates and related components in Brisbane, Bayside, Moreton Bay, Redlands, Redland Bay, Logan, Ipswich, Scenic Rim, Morayfield, Beachmere, Tamborine, Hope Island and Walloon, and surrounding areas, subject to availability.
1.2 Licensed building work is carried out under QBCC Licence No. 15501905.
2. Quotes and Pricing
2.1 A Quote is based on the information you give us and the conditions we can see or reasonably anticipate at the time. Quotes given by phone, online or without inspection are estimates only.
2.2 Unless stated otherwise, a Quote is valid for 14 days from the date of issue. After that we may change the Quote, including the price.
2.3 If the site dimensions, site conditions or scope differ from what was provided to us or what we could reasonably anticipate, we will tell you before proceeding and the price may change. We will not carry out additional work that increases the price without your agreement.
2.4 Prices are in Australian dollars and include GST unless stated otherwise.
2.5 Where the law requires a written contract for the work, we will provide a written contract that complies with the law and it will prevail over any estimate.
2.6 Prices published on the Website are a guide only (see our Website Terms of Use).
3. Variations
3.1 Any change to the agreed scope, goods or price must be agreed in writing (email or text message is sufficient) before the work is done, except where urgent work is needed to make the site safe and we cannot reach you.
3.2 A variation may change the price and the time needed to complete the work. We will tell you the effect before proceeding where reasonably possible.
4. Scheduling and Access
4.1 Appointments are subject to availability. We will give you an arrival window and aim to arrive within it.
4.2 We may reschedule an appointment due to circumstances beyond our reasonable control, including weather, emergencies, safety concerns or parts availability. We will tell you as soon as reasonably possible and offer a new time.
4.3 You must provide safe, clear and unobstructed access to the site and work area at the agreed time, and ensure you or an authorised person is present or contactable.
4.4 If we cannot start or complete the work because of restricted access, incomplete or incorrect site information, or unforeseen site conditions that you did not tell us about, we may charge a reasonable additional fee (including a call-out fee and the time and cost of a return visit).
5. After-Hours and Emergency Services
5.1 Emergency and after-hours services are subject to availability.
5.2 After-hours, weekend and public holiday services may incur additional charges. Any applicable charges will be stated in your Quote and confirmed before you book.
6. Payment
6.1 Unless otherwise stated in the Quote or agreed in writing, payment in full is due on completion of the Services.
6.2 Any deposit, progress payment or payment terms will be set out in the Quote or confirmed before you accept it. A deposit may be required for special-order parts or custom doors and gates.
6.3 We accept the payment methods stated in the Quote or booking. Any applicable surcharge will be disclosed before payment.
6.4 If you do not pay by the due date, we may charge reasonable interest and recover our reasonable costs of collection, to the extent permitted by law.
6.5 You must not withhold payment unless you have notified us in writing of a genuine dispute about the work, in which case you must pay any undisputed amount on time and we will work with you in good faith to resolve the dispute under section 17.
7. Ownership of Goods and Security Interest
7.1 To the extent permitted by law, ownership of Goods supplied by us does not pass to you until you have paid for them in full.
7.2 Until payment is made in full, you must keep the Goods in good condition and not sell, remove or encumber them without our written consent.
7.3 You acknowledge that this clause may create a security interest in the Goods under the Personal Property Securities Act 2009 (Cth), and we may register that interest on the Personal Property Securities Register. You agree to give us the information we reasonably need to do so.
7.4 If you do not pay for Goods that can be removed without unreasonable damage, we may recover them after giving you reasonable written notice. We will only enter your property with your consent, or as otherwise permitted by law, and will not use force or breach any law to do so.
8. Risk and Insurance
8.1 Risk in the Goods passes to you on delivery or installation, whichever happens first. This does not limit our responsibility for defects or for loss or damage caused by our negligence.
8.2 After installation you are responsible for insuring the Goods and the property.
9. Safety
9.1 Garage door springs, cables and automatic gates and doors store energy and can cause serious injury or death. Do not adjust, repair or release springs, cables, brackets or tensioned parts yourself. Contact a qualified technician.
9.2 We strongly recommend that every automatic door or gate has safety devices such as photoelectric (photo-eye) sensors, entrapment protection and a working manual release, and that you regularly test them.
9.3 We may refuse, or stop, any installation or repair that we reasonably believe is unsafe or does not comply with applicable laws and standards. This includes installing automatic closing mechanisms without appropriate safety devices. In that case you must pay for work already carried out and any call-out fee, to the extent permitted by law.
9.4 We may recommend work needed to make a door or gate safe. If you decline that work, you accept responsibility for the risks arising from that decision, to the extent permitted by law.
10. Client Responsibilities
You are responsible for:
- providing safe access to the property and work area;
- telling us about relevant pre-existing conditions (such as structural damage, rot, uneven ground, concealed services or electrical issues);
- providing, or arranging for a licensed electrician to provide, the power supply and electrical connections required for the equipment, unless included in the Quote;
- removing vehicles, pets, children, fragile items and valuables from the work area;
- confirming property boundaries and obtaining any required approvals, such as body corporate, council or landlord approval, and ensuring the installation complies with applicable regulations; and
- using and maintaining the Goods in accordance with our and the manufacturer's instructions.
11. Site Conditions and Existing Structures
11.1 We will take due care and skill when working on your property. We are not liable for damage to existing concealed or unknown infrastructure, such as plumbing, wiring, drainage or surfaces, unless the damage was caused by our failure to exercise due care and skill.
11.2 We will remove old doors, gates or structures only if this is included in the Quote.
11.3 A residential operator or door is not designed for commercial or industrial use or heavy-duty cycles. We are not responsible for failure caused by use outside its rated purpose unless we agreed in writing to supply it for that use.
12. Warranty
12.1 Labour warranty: unless your Quote states otherwise, we warrant our workmanship for 3 years from the date the work is completed. We will repair or redo defective workmanship at no charge.
12.2 Goods: Motors are covered by a 3-year warranty. Other Goods not manufactured by us are covered by the manufacturer's warranty. We will help you lodge a claim where reasonable. Warranty terms are available on request.
12.3 Exclusions: warranties do not cover faults caused by misuse, negligence, accident, unauthorised repairs or modifications, lack of recommended maintenance, vermin, natural disasters or other events outside our control, or normal wear and tear. This clause does not apply to the extent a consumer guarantee or statutory warranty applies.
12.4 Warranty service hours: warranty work is carried out during business hours (Monday to Friday, 7:00 am to 5:00 pm), excluding public holidays. Warranty work outside those hours may incur additional charges, unless a consumer guarantee requires otherwise.
12.5 Making a claim: contact us as soon as you become aware of a problem and give us a reasonable opportunity to inspect it. Keep your invoice as proof of purchase.
12.6 Our warranties are in addition to, and do not replace, your rights under the ACL and any statutory warranties under Queensland legislation, including those that apply to domestic building work.
13. Your Rights Under the Australian Consumer Law
13.1 Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
13.2 Services must be provided with due care and skill, be fit for any purpose you made known to us, and be supplied within a reasonable time.
13.3 Nothing in these Terms excludes, restricts or modifies any right, remedy or guarantee that cannot lawfully be excluded, including under the ACL. These Terms apply only to the extent permitted by law.
14. Limitation of Liability
14.1 To the maximum extent permitted by law, and subject to clause 13, we are not liable for indirect or consequential loss, including loss of profits, loss of use or loss of income, arising from the Services or Goods.
14.2 If we are liable for a breach of a guarantee, condition or warranty that can be limited under the ACL (for example, where the Goods or Services are not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option and to the extent permitted by law, to:
- for Goods: replacing them, supplying equivalent Goods, repairing them, or paying the cost of doing any of those things; and
- for Services: supplying the Services again or paying the cost of having them supplied again.
14.3 Nothing in these Terms limits our liability for death or personal injury, for fraud or misleading or deceptive conduct, or for loss caused by our negligence that cannot lawfully be excluded.
15. Cancellations, Returns and Special Orders
15.1 Please tell us as soon as possible if you need to cancel or reschedule an appointment. If you cancel or reschedule with less than 72 hours' notice, or we arrive and cannot do the work through no fault of ours, we may charge a reasonable fee that reflects our genuine losses, up to our call-out fee. We will tell you any applicable fee before the booking is confirmed.
15.2 You may cancel an order for standard stock Goods before they are ordered, delivered or installed. We may charge a reasonable fee for costs we have already incurred.
15.3 Custom-made or special-order Goods (such as made-to-measure doors and gates) cannot be cancelled once production or ordering has begun, except as required by law or agreed in writing by us. We will tell you this before you place the order. Any deposit will be dealt with as set out in your Quote and the law.
15.4 If an order is deferred at your request, we may charge reasonable storage costs.
15.5 Claims about the quality or condition of Goods should be made as soon as practicable after delivery or installation so that we can inspect them. Returns require our prior authorisation, except where you are entitled to a remedy under the ACL. This clause does not limit your rights under the ACL.
15.6 Cooling-off: if we supply you with goods or services after a visit or call you did not invite or request (an unsolicited consumer agreement), you have the cooling-off rights set out in the ACL, including the right to cancel within the cooling-off period. We will give you the information required by law.
16. Product Information and Changes
16.1 We may change product designs, brands and specifications without notice where the replacement is equivalent or better, or you agree to the change.
16.2 Colours and finishes may vary slightly from samples, photos and screens due to materials and manufacturing processes.
17. Complaints and Disputes
17.1 If you are unhappy with our Services, please contact us first at info@anytimegaragedoors.com.au or (07) 3607 5698, with your name, address and a description of the problem. We will acknowledge your complaint promptly and try to resolve it fairly and quickly.
17.2 If we cannot resolve it, you may contact the Queensland Building and Construction Commission (QBCC) about building work, or the Office of Fair Trading Queensland about consumer issues.
18. Privacy and Communications
We handle personal information in accordance with our Privacy Policy at agdag.com.au/privacy-policy. We may contact you about your booking by phone, SMS or email. We send marketing messages only with your consent or where permitted by law, and you can opt out at any time.
19. General
19.1 Entire agreement: to the extent permitted by law, these Terms and your accepted Quote or written agreement are the entire agreement between you and us about the Services and Goods. This does not exclude or limit any representation or conduct that cannot lawfully be excluded, including under the ACL.
19.2 Changes: we may update these Terms from time to time. The Terms that apply to a particular job are those in force when your Quote is accepted or your booking is confirmed.
19.3 Severability: if a provision is invalid or unenforceable, it is severed and the rest continues in full force.
19.4 No waiver: our failure or delay in enforcing a right is not a waiver of that right.
19.5 Assignment: you may not assign your rights under these Terms without our written consent.
19.6 Governing law: these Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
